Service Agreement

Please review the terms of service, cancellation process, and refund policy before using our website design services.
1. Project Overview

WebWhiz Limited agrees to design and develop a website for the clients, incorporating the features and requirements outlined in this agreement and any supporting documentation mutually agreed upon by both parties.

2. Project Timeline

The WebWhiz Limited agrees to complete the website design and development within 30 days from the date of the initial deposit payment, provided that the Client supplies all necessary content, feedback, and approvals in a timely manner.

3. Delays

If delays occur due to incomplete information, late feedback, or other factors beyond the WebWhiz’s control, the completion date may be extended with mutual understanding.

4. Client Responsibility

The Clients agrees to provide any requested content, images, and information promptly to avoid delays. Failure to do so may result in an adjusted timeline.

5. Scope of Services

The WebWhiz will design a professional website as per the Client's requirements.

The website package includes:
• Customized layout and design
• Mobile responsiveness
• User-friendly navigation
• Free SSL Certificate to ensure secure data transmission
• Malware scans to protect against security threats
• 99% uptime guarantee for consistent website availability

6. Payment Terms

WebWhiz offers two website packages to meet different client needs. The Business Pack includes a one-time setup fee of $199 NZD (non-refundable) and a monthly hosting and maintenance fee of $14.99 NZD, continuing until canceled by the client. This package provides a professional website with all standard features included. The E-Commerce Pack is designed for online stores and includes a one-time setup fee of $399 NZD (non-refundable) with a monthly hosting and maintenance fee of $24.99 NZD, ongoing until canceled. This package includes full e-commerce functionality. One-time setup fees cover design, development, and standard services only and are non-refundable, while monthly fees are ongoing and can be canceled at any time by the client.

7. Domain Registration

The domain name is not included in any package. You can register a domain independently, and we will assist you in connecting it to our hosting services. Alternatively, you can purchase the domain through WebWhiz for an additional annual fee, which may vary depending on the chosen domain and any third-party charges. Please note that domain prices are subject to change if the provider adjusts their rates.

8. Website Transfer, Ownership, and Termination

Either party may terminate this agreement at any time. Clients can cancel their services by logging into their account and deactivating the service. All payments made are non-refundable. Once the paid term expires or the service is deactivated, WebWhiz Limited is not responsible for any data loss, as the website and associated content will be discontinued. Any work completed up to the termination or deactivation date remains the property of WebWhiz Limited unless the client requests a website transfer by contacting info@webwhiz.co.nz and agrees to pay the applicable transfer service fee.

9. Uptime and Security

WebWhiz Limited guarantees 99% uptime for the Client's website, ensuring it remains accessible and functional for the majority of time. Comprehensive security features, including wildcard SSL, brute-force protection, IP block management, and enterprise-level DDoS protection. Daily website scans for malware, SQL injection attacks, and application vulnerabilities, while SiteLock effectively blocks harmful traffic.

10. Liability and Consumer Guarantees

The Service Provider will make every effort to ensure the website is error-free; however, the Client acknowledges that ongoing updates and maintenance are essential for optimal performance. This contract complies with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, which entitle the Client to guarantees regarding service quality, timeliness, and reasonable care.

11. Dispute Resolution

In the event of any dispute, both parties agree to negotiate in good faith to resolve it. If a resolution cannot be reached, either party may seek mediation in accordance with the Disputes Tribunal Act 1988.

12. Acceptance and Consent

By accepting these terms, the Client agrees to the payment structure and obligations outlined in this agreement, including all one-time setup fees, ongoing monthly fees, and any additional charges as applicable.
